General Terms and Conditions of Sale

Introduction
The present general terms and conditions govern the relationship between the Centro culturale LAC Lugano Arte e Cultura (hereinafter LAC) and its customers. They are an integral part of all contracts for the purchase of tickets stipulated with the LAC. Acceptance of these general conditions is presumed from the moment the customer purchases a ticket or subscription. These general conditions shall also apply to events organised by third parties (external organisers) in LAC's premises. Different agreements between external organisers and visitors must be approved in advance by the LAC.

Advance ticket sales
The date on which the advance sale of tickets for a performance, activity, event or exhibition commences is set by LAC or the organiser, published on the LAC website (www.luganolac.ch) and made public in other publications.
LAC reserves the right to limit the number of tickets available per person. For group orders (> 10 persons), please contact the organiser responsible for the event directly.
Cash payments in Swiss francs only are accepted at the LAC ticket office.

Orders/reservations/purchases
When purchasing online via TicketDirect, tickets can be printed out at home free of charge as a pdf file. For postal delivery by the LAC, however, there is a charge of CHF 7 per order.
The purchase contract is binding from the moment the tickets are paid for in full.
In the case of online ticket purchases, the effect is binding from the moment the order is confirmed, after the customer has selected specific seats for a specific service and has entered his or her own and credit card details.
Once purchased, tickets are neither returned nor exchanged. Expired tickets will not be exchanged.
The resale of tickets purchased by the LAC for commercial purposes is prohibited without prior authorisation from the LAC.
Tickets must be paid for in Swiss francs. For international customers, any currency differences are to be attributed to the exchange rate set by the bank providing the customer's credit card.

Reductions
Reductions are granted to persons fulfilling the correct requirements, upon presentation of a valid identity document. Individual reductions are not cumulative.
Certain types of reduced price tickets can only be purchased at the LAC ticket office. Relevant information can be found directly at the LAC or on the website www.luganolac.ch.
LAC reserves the right to limit or exclude the sale of reduced-price tickets for certain venues, events or price categories. Furthermore, the LAC may change the amount of the reductions at any time.

Conditions of use of LAC+ membership
LAC+ membership and the benefits associated with it are personal and non-transferable. The venue staff may carry out spot checks to ensure that it is being used correctly.
LAC+ membership allows the member to reserve tickets for performances included in the membership at no additional cost. However, a seat is not guaranteed: each member must make a ticket reservation for the shows they wish to attend, subject to remaining availability. Reservations can be made online via your personal account, by telephone or at the box office.
The 20% discount (40% for young people under 25) applies to the full price of tickets for all performances organised by the LAC that are not included in the membership. The discount cannot be combined with other reductions. For shows with more than one performance, it is possible to book only one ticket per show, or two for those who have subscribed to the ‘DUO’ formula.
In the event of being unable to attend a booked event included in the membership, the member must cancel the reservation, either online via their account or by contacting the box office, so that the seat can be reassigned.
Out of respect for other spectators and in order to ensure fair access to performances, the LAC reserves the right to monitor non-cancelled non-attendances(no-shows). In the event of two unexcused absences, consecutive or non-consecutive, the member will receive a warning. The third absence without prior cancellation may incur a penalty equal to the value of the ticket with a 20% discount, corresponding to the unused seat. Any penalties will be communicated and invoiced by e-mail.
The membership can be subscribed to at any time, at the ticket office or online, and is valid for one year. It does not expire for those who continuously pay the fee. You must have an active membership in order to benefit from the relevant advantages.

Promotions
The conditions for individual promotions are specified in the promotion notice.

Hall seating capacity
The capacity of seats in the auditorium is limited to the quantity indicated on the website. The LAC reserves the right to change the seating plan and allocate equivalent or similar seats to customers if such a change makes the reserved seats no longer available.

Gift vouchers
LAC gift vouchers can be used for all Theatre, Dance, Music and Musical performances organised by the LAC, for concerts by LuganoMusica and the Orchestra della Svizzera italiana, or for admission to MASILugano exhibitions. Some gift vouchers may, however, be limited to specific shows or to individual organisers; such limitations will be indicated on the voucher itself and communicated to the customer.
LAC gift vouchers are valid for two years from the date of issue and are non-refundable. Gift vouchers can be redeemed at the ticket office, by telephone or online. For online redemption, the value of the voucher must be at least equal to the amount to be paid.
LAC gift cards (LAC Card) with a positive balance as of 04.06.2019 will be converted into virtual gift vouchers with a two-year expiry date.
Lost vouchers will not be replaced.

Opening hours
The ticket office is open at the times indicated on the LAC website. In the case of evening performances on Mondays (LAC's closing day), the ticket office opens 90 minutes before the start of the performance.

Recordings made at the LAC
The LAC makes audio-visual or photographic recordings of performances, activities and exhibitions. The client accepts that such recordings may be broadcast on television, published on DVD and posted on the web in digital or other form, even if the client is recognisable in such recordings.

Audio and video recordings
For copyright and privacy reasons, visitors are not permitted to make video or audio recordings of performances, activities and exhibitions at the LAC. Violations may result in claims for damages and the exclusion of the client from the event without refund of the ticket price. The deletion or destruction of recordings made with the relevant media may be requested.

Programme and starting times
The LAC and the organisers reserve the right to cancel performances, to replace them with other works and to change the schedule or cast, even after ticket pre-sales have begun. The definitive starting times can be found on the LAC website. If the performance is cancelled, substituted or moved by date, the customer is entitled to a refund of the ticket.
In the event of changes to the cast or to the starting time of a performance, the cost of the ticket will not be refunded.
The LAC accepts no responsibility for information provided on posters or other publications.

Performances
For performances at the LAC, doors open 15-30 minutes before the starting time indicated on the ticket.
A valid ticket or season ticket and, in the case of reduced tickets, an identity document and/or ID card must be shown to the theatre staff upon entry. If a valid ID card is not shown to the hall staff, the difference to the full price must be paid at the LAC ticket office. Tickets purchased online via TicketDirect are valid.
Severely damaged, illegible, forged or copied tickets are not considered valid.
Customers without valid tickets will not be admitted to any performance.
Once a performance has started, for safety reasons and in the interest of the artists and the audience in the auditorium, late customers are only permitted to enter during spontaneous applause and/or any scene changes. In these cases, customers may not make any claims for purchased seats and must comply with the instructions of the theatre staff. Customers may not make any claims for reimbursement.

Cancellation, postponement or interruption of performances
The LAC and the organisers reserve the right to cancel performances, replace them with other works and change the time or cast, even after ticket pre-sales have begun.
In the event of changes to the cast or starting time of a performance, the ticket price will not be refunded.
In the event of the cancellation of a performance, the customer is in the first instance reimbursed by means of a replacement voucher of the same value as the ticket purchased; at the customer's explicit request, a cash refund can be obtained by sending an email to biglietteria@laclugano.ch, and the refund is generally made using the same method of payment as was used for the purchase.
As a rule, in the event of a performance postponement, tickets remain valid for the replacement date. Should the customer be unable to attend the event on the proposed new date, a refund will first be made by means of a replacement voucher of the same value as the purchased ticket; at the customer's explicit request, a cash refund can be obtained by sending an email to biglietteria@laclugano.ch, the refund is generally made using the same method of payment as was used for the purchase.
For cancellation, postponement and termination of performances, only the value of the purchased ticket will be refunded. Beyond this, no other expenses or damages advanced by the customer will be reimbursed.
The deadline for requesting a refund is 30 days from the announcement of the cancellation or postponement of the performance.
In the event of the interruption of a performance, ticket holders are only entitled to a refund if this occurs before the first intermission or, in the case of a performance without an intermission, before half the scheduled duration of the performance. Claims must be asserted in the same way as in the case of cancellation.

Domiciliary rights
The LAC exercises its domiciliary rights in all its venues and spaces and has the right to eject, prohibit entry to its premises, or take any other measures deemed appropriate to protect security and peace of mind. In particular, visitors may be expelled from any event and LAC premises if they disturb third parties in any way or have violated these general conditions in any other significant way. Admission may also be refused if there are reasonable grounds to believe that the customer may disrupt the performance or harass other members of the public. In such cases, the ticket will not be refunded.
The customer is only entitled to access the hall and the seat indicated on his or her ticket. Should he/she find him/herself in another hall or in another seat than the one assigned on the ticket, the LAC shall be entitled to charge any difference in price and to eject the customer from the performance.
Mobile telephones, pagers and acoustic signal transmitters of any kind may only be brought into the auditorium if they are switched off, set to aeroplane mode or made silent. Under no circumstances may they disturb third parties.

The consumption of food and drink inside the LAC halls is forbidden. Smoking is forbidden throughout the cultural centre. In the event of a fire or other dangerous situation, the building must be evacuated immediately and without distraction, via the designated exits and emergency exits, following the instructions given by LAC personnel. In this case, items deposited in the cloakroom will not be distributed.

Liability
The LAC shall be liable for any damage suffered by visitors to the premises of the cultural centre only in the event of negligent or intentional breach of contractual obligations by its employees and auxiliaries. The LAC accepts no liability for consequential damage or loss of profits. Liability for damage to life, limb and health remains unaffected.

Data protection
Personal data will be kept strictly confidential and will not be sold or transferred to third parties (see privacy policy). This will be done unless the transfer is necessary for payment settlement or shipping. In this case, we have concluded agreements with the organisers to ensure compliance with data protection regulations and the immediate deletion of data that is no longer required.

Applicable law and place of jurisdiction
These general terms and conditions shall be governed exclusively by Swiss law, and the ordinary courts of law of the City of Lugano shall have jurisdiction over any legal disputes. Swiss law shall apply. For any legal dispute, the courts of the City of Lugano shall have jurisdiction.
